These Terms of Service ("Terms") govern your access to and use of the BLEUM voice automation platform and related services (the "Service") provided by BLEUM, Inc. ("BLEUM," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
BLEUM provides an AI-powered voice automation platform that enables businesses to create, manage, and deploy automated voice interactions. The Service includes:
To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify BLEUM of any unauthorized use of your account.
Organization owners may invite additional users with varying permission levels. The organization owner is responsible for managing user access and ensuring all users comply with these Terms.
The Service is offered through tiered subscription plans (Starter, Growth, Pro) with varying features, call minute allocations, and pricing. Current plan details are available on our pricing page.
New accounts may be eligible for a free trial period. During the trial, you will have access to the features of your selected plan. Your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel before the trial ends.
Subscriptions are billed in advance on a monthly or annual basis. All fees are quoted in U.S. dollars and are non-refundable except as expressly stated in these Terms. Payment is processed through Stripe, and you agree to Stripe's terms of service.
If your usage exceeds your plan's included minutes, overage charges may apply at the rates specified in your plan. You can enable or disable overages in your billing settings.
We may change our prices from time to time. Price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing period.
Cancellation Policy:
If you reactivate your account within the 30-day data retention period, your data, procedures, and settings will be restored. After the retention period, a new account must be created.
Refunds are generally not provided. In exceptional circumstances, refund requests may be submitted to [email protected] and will be reviewed on a case-by-case basis.
You may use the Service for lawful business purposes in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

The Service, including its software, design, features, and documentation, is owned by BLEUM and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.
You retain ownership of all content you upload or create using the Service, including voice procedures, knowledge base entries, and call data. You grant BLEUM a limited license to process this content as necessary to provide the Service.
If you provide feedback, suggestions, or ideas about the Service, you grant BLEUM the right to use that feedback without restriction or compensation.

BLEUM commits to 99.5% uptime for the Service, measured monthly, excluding scheduled maintenance windows.

The uptime commitment does not apply to: scheduled maintenance (with 24-hour notice when possible), force majeure events, third-party service outages (Twilio, Deepgram, etc.), issues caused by your equipment, network, or software, or API abuse or usage exceeding plan limits.
Service credit requests must be submitted within 30 days of the incident to [email protected]. Credits are applied to future billing periods and may not exceed 50% of your monthly fee.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
BLEUM does not warrant that: the Service will be uninterrupted or error-free, the Service will meet your specific requirements, results obtained from the Service will be accurate or reliable, or any AI-generated responses will be error-free or suitable for any particular purpose.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLEUM'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO BLEUM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
IN NO EVENT SHALL BLEUM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
You agree to indemnify and hold harmless BLEUM, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: your use of the Service, your violation of these Terms, your violation of any applicable law or regulation, or your content or data processed through the Service.
Before filing a formal dispute, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.
If informal resolution fails, any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
These Terms, together with the Privacy Policy and any order forms or service agreements, constitute the entire agreement between you and BLEUM regarding the Service.
We may modify these Terms at any time by posting updated Terms on our website. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond its reasonable control, including natural disasters, war, terrorism, strikes, or government actions.
